Terms and conditions
1. Definitions
1.1. Unless the context provides otherwise, the words and expressions set
out below will have the following meanings and cognate expressions
shall have corresponding meanings:
1.1.1. “Competition” means the South African Traditional Music Awards,
organized by Mageza Heritage Foundation.
1.1.2. “Competition Period” means start date 31st August 2024 at
00:00:01 hours and end date [Dd-Mm-Yyyy] at 00:00:00 hours.
1.1.3. “Participant” means a person who participates in a campaign.
1.1.4. “Promoter” means Mageza Heritage Foundation.
1.1.5. “Prize” means: Cash; a share of up to ZAR 19,000.00 weekly.
2. Application of Terms and Conditions
2.1. By choosing to enter the Competition, the participant agrees to be
bound by the following terms and conditions, which the participant
acknowledges to have read and understood.
3. Entry Requirements
3.1. In order to be eligible for participation in this Competition an entrant must:

3.3. To enter participate, participants must:
3.3.1. Send the Nominee Code to a designated short code and play the game.
3.4. SMS Cost shall be ZAR 1.50 per SMS.
3.5. Participants may vote as many times as they can afford.
3.6. Provide the correct information requested.
3.7. Participants should provide accurate Personal information to be eligible
to win. Failure to do so shall render the participant ineligible from
collecting his/her winnings.
3.8. Personal information shall be requested from the participant before the
winnings are awarded. Failure to provide said information shall render
the participant ineligible from collecting his/her winnings.
4. Award Terms
4.1. Weekly Cash Prize winner/s will be contacted within 24 hours after announcement.
4.2. After all the required Personal information is received, the winnings shall be credited into the Prize winner’s account within 7 days.
4.3. The Prize winner submits that all content shared with the Promoter may be used freely, without consultation on all platforms and may be amended in any way the Promoter sees fit without compensation. The
Prize winner has at any time the right to decline the use of its content.
5. Use of Personal Information
5.1. Personal information is information relating to a participant. Personal
information includes a participant’s identity or passport number and
contact details.
5.2. By entering this competition, a participant agrees that the Promoter
may use his/her personal information in connection with the competition. Any personal information submitted by the participant will be used solely in accordance with current South Africa POPIA. For any

[phone number]5.3. 5As far as the law allows, each participant agrees and gives the Promoter permission to collect, get, receive, record, organize, collate, update, use and share all of his/her personal information for all purposes relating to the competition.
5.4. Each participant warrants that he/she has the authority to allow the Promoter to use his/her personal information for purposes of the competition. The Promoters will not use any participant’s personal
information in any way which breaks the law and undertakes to keep all personal information of participants secure and for as long as the law requires.
5.5. 5.5. By entry in this competition, all participants consent to having their
data captured on the Promoters’ system. The participant agrees that any video or photographs taken of them in relation to this competition become the property of the Promoter to use in any marketing campaigns as the Promoter deems fit. The participant shall have no
claim for any compensation for use of the media footage. However, the participant is at all times free to decline and not consent to such use.
6. Warranties and Indemnities
6.1. The Promoter, its employees, officers, directors, agents and associates, (the “Indemnified Parties’’) shall not be liable for and the participants hereby indemnify and hold the Indemnified Parties harmless from any claim, liability, cost, expense or penalty suffered or incurred by any person as a result of participating in the competition.
6.2. All products given as part of the Prizes are subject to all applicable
warranties, guarantees and instructions of use accompanying such
products.
7. Force Majeure
7.1. In the event of any act of God, strike, war, warlike operation, rebellion,
riot, civil commotion, lockout, combination of workmen, interference of
trade unions, suspension of labor, fire, accident, of any circumstances arising or action taken beyond or outside the reasonable control of the
Promoter preventing them from the performance of any obligation to a Participant (any such event hereinafter called “Force Majeure”) the Promoter shall promptly notify and seek appropriate relief from the
Gambling Authority.
7.2. the Participant during the period that such Force Majeure continues and shall not be liable for any delay or failure in the performance of any obligations or loss or damage which the Participant may suffer due to
or resulting from the Force Majeure.
8. General
8.1. The Promoter acknowledges that any amendments to these terms and conditions require the approval granted by the Gambling Authority, and such changes cannot be made solely at the Promoter’s discretion.
8.2. The Competition is not open to any director, member, partner, owner, employee, agent of, consultant to, or anyone associated with or affiliated to the Promoter.
8.3. In the event of a dispute regarding any aspect of the Competition and/or these terms and conditions, the Promoter’s decision will be binding and final and no correspondence will be entered into.
8.4. The Promoter shall not cancel, suspend, or terminate the service without the explicit consent of the Gambling Authority.

9. Participant Conduct and Eligibility.
9.1. Participants must adhere to fair play and ethical conduct throughout the competition.
9.2. The Promoter reserves the right to disqualify participants found engaging in fraudulent activities, cheating, or any behavior that undermines the integrity of the competition.
9.3. Employees, immediate family members, and business associates of the Promoter are ineligible to participate in the Competition.
10. Entry Fees and Charges
10.1. Participants are accountable for any SMS charges or data fees accrued
during competition entry.
10.2. Participation in the competition does not guarantee winning a prize; success is contingent on the participant’s skill and chance.
10.3. SMS costs BWP 1.50.
10.4. 1All taxes, fees, and levies on prizes are the sole responsibility of the
winners.
11. Publicity and Promotion
11.1. 12.1. Participants and winners consent to their names and likeness being used by the Promoter for promotional purposes without any compensation.
11.2. 12.2. The Promoter retains the right to feature winners in promotional
material, including but not limited to social media, press releases, and advertisements.
12. Disputes
12.1. Any disputes arising from the competition will be resolved according to
the laws of the Republic of South Africa.
12.2. Participants agree to abide by the Promoter’s decisions on all matters
related to the competition, including dispute resolution.
13. Limitation of Liability
13.1. 14.1. The Promoter, its agents, affiliates, and sponsors will not be liable for any loss, damage, injury, or inconvenience suffered by participants
during the competition.
13.2. 14.2. The Promoter shall not be responsible for any technical malfunctions, interruptions, or errors in the competition operation.
14. Governing Law and Jurisdiction
14.1. These terms and conditions are governed by the laws of the Republic of South Africa.
14.2. Any disputes arising from or related to the competition shall be subject to the exclusive jurisdiction of South African courts.
15. Severability
15.1. If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall continue to be in full force and effect.
16. Language
16.1. These terms and conditions are provided in the English language. In case of any discrepancy, the English version shall prevail.
